Terms of Service: FireAvert PRO Monitoring
Welcome to FireAvert
Thanks for using FireAvert’s products, equipment, and PRO Monitoring Services (“Services”). These Services include access to the FireAvert PRO Monitoring Dashboard, text alerts, and remote reset of your stove. FireAvert is the brand through which we bring you the FireAvert PRO Services.
FireAvert Equipment
FireAvert may provide or rent various pieces of equipment to you in connection with the Services. In some cases, to use the provided equipment, you will need to review and agree to terms of service governing the use of the equipment.
If you lose or damage this equipment after delivery or installation, FireAvert may charge you a fee for replacement equipment (see Fee Schedule). Equipment fees are subject to change.
Unless explicitly stated otherwise on our website or in your Service Agreement, FireAvert owns all equipment provided by FireAvert in connection with the Services.
Billing and Payment
You agree to pay any and all applicable fees for the Services you purchase, whether ordered by you, someone authorized by you, or someone with access to the Services pursuant to your FireAvert account.
FireAvert will send all bills and other required notices by email to the address associated with your account. You may also access this information through your online FireAvert account. You agree to pay recurring monthly Service fees in advance of the billing cycle in which you will receive the Services.
Automatic Payments: You authorize FireAvert to automatically collect payments of any and all fees associated with your use of the Services from your designated payment method.
Failed Payments and Suspension: If payment is not received due to insufficient funds or for any other reason, FireAvert may, consistent with applicable laws, attempt three (3) times every three (3) days. If all three (3) payments fail, FireAvert will suspend or terminate the Services. You agree that FireAvert is not responsible for any third-party charges you may incur in connection with your bank, credit card, or other payment method.
Reinstate Services: If you request that FireAvert reinstate any suspended or terminated Services, within thirty (30) days, according to the Equipment Return policy, FireAvert will charge you the associated subscription fee.
Changing and Canceling Services; Termination
You may cancel the Services at any time, but you may be required to return some or all of the equipment. If you do not return this equipment, you may be required to pay a replacement fee.
Your FireAvert account will not be terminated until all billing obligations are resolved. If there is a credit balance at the time your account is terminated, it will be refunded to the last used payment method in your FireAvert account.
FireAvert Fees and Equipment Return Policy
Your FireAvert PRO Services may come with certain equipment, such as devices that allow you to detect hazards, monitor appliances, and transmit data to the FireAvert cloud (e.g., Gateways, or Sensors). The specific equipment you receive will depend on your Service plan, your order, and will also be shown in your FireAvert account.
Liability for Equipment: Regardless of your Service plan, you will be required to pay the applicable Replacement Fees, plus applicable taxes, if you lose or damage any of the equipment owned by FireAvert.
Return of Equipment upon Cancellation: If you cancel all of your Services, you must return all of the equipment provided to you as part of the Services (except for any additional equipment you purchased directly from us to own) in working condition and with all accessories such as power cables.
- FireAvert Equipment: You must return your FireAvert Auto Stove Shutoff, Small Appliance Shutoff, or any other FireAvert device if you cancel your PRO Monitoring Service.
- Gateways and Hubs: You must return your Gateway/Hub if you cancel your PRO Monitoring Service.
- Non-Return Fees: If you do not return the applicable equipment in good working order within thirty (30) days after your applicable Service is terminated, you will be responsible for the applicable Replacement Fees below, plus applicable taxes.
